‘Rush to ASIC’: White-collar whistleblowers to get legal immunity – The Australian Financial Review
Employees who blow the whistle on serious white-collar crime will be eligible for immunity from legal action under a new policy announced by ASIC.
People found to have committed such offences face up to 15 years in jail and fines up to $1 million or three times the benefit of the contravention.
Mark Wilks, head of commercial litigation at Corrs Chambers Westgarth, said ASICs new policy could result in a race to the door of the corporate regulator, and could represent a shift in focus.
It may reflect ASICs intention to shift focus away from technical regulatory breaches and instead focus on serious criminal misconduct, he said.
