On Wednesday, the High Court set aside previous orders made by the Court of Appeal in Queensland’s Supreme Court in November 2019.

Five High Court judges overturned the previous rulings of the Land Court of Queensland, saying it had been influenced by the “apprehension of bias”.

It also ruled the application by the protest group, Oakey Coal Action Alliance, should be referred back to the Land Court of Queensland to be reconsidered.

The mine sits in the LNP seat of Condamine, held by Mr Weir, who described the court ruling as a “hammer blow” to the Oakey and Darling Downs community.
