Cochlear loses final appeal hope in patent infringement case – The Australian Financial Review
Cochlear must fork out $US280 million in damages and $US75 million in legal fees after exhausting all of its appeal options in a patent infringement case.
Hearing implant maker Cochlear has lost its final chance to appeal the hefty $US268 million ($356.5 million) of damages it has been ordered to pay two US research institutions due to patent infringement violations.
On Tuesday, it announced the US Supreme Court had denied its petition for a review of the US Federal Circuit Court’s decision to uphold the damages against it as a result of a lawsuit by the Alfred E. Mann Foundation for Scientific Research and Advanced Bionics.
