Truck driver who killed Logan bus driver walks free after winning appeal

The prosecutor argued the evidence showed the truck was travelling about 80 kilometres per hour just before it entered the bend, despite signs recommending 40 kilometres per hour on the bend.

The prosecutor said the evidence also showed Mr Gallaty’s dangerous driving caused Mr Bohlsen’s death because the trailer’s brakes locked up due to the truck hitting the bend at excessive speed.

The prosecutor also submitted that an ordinary person in Mr Gallaty’s position would have known the ACSM activated at the possibility of instability and if the ACSM operated when negotiating a bend and the trailer wheels locked up, the trailer could slide into oncoming traffic.
