The judge noted Mr Brown had alleged only that Rio Tinto or its senior executives had believed the firm that he would take a lead role in the project, rather than relied on the representation to take some action.
“It is difficult to see how the pleaded representations to Rio Tinto could have caused Mr Brown any loss or damage even if Rio Tinto had relied on the representations,” he said.
“In the circumstances, the best course is to strike out the whole of the cause of action.”
